These Terms govern your use of warlitjgrouppty.site and services provided by Warlitj Group Pty Ltd (ABN 79 697 022 147 / ACN 697 022 147). By accessing our Site or engaging our services, you agree to be bound by these Terms.
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, including the Competition and Consumer Act 2010 (Cth) (incorporating the Australian Consumer Law), the Aboriginal Heritage Act 1972 (WA), and the Work Health and Safety Act 2020 (WA).
Warlitj Group provides construction, land management, cultural consulting, community programs, facilities maintenance, and project management services across Western Australia. The scope, fees, and deliverables for each engagement will be set out in a written service agreement, contract, or purchase order.
Fees will be specified in your service agreement. All fees are in AUD and inclusive of GST where applicable. Invoices are payable within 30 calendar days of issue unless otherwise agreed. GST is applied in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
All work is conducted in compliance with the Work Health and Safety Act 2020 (WA) and associated regulations. We maintain comprehensive WHS management systems and hold all relevant insurances including public liability, workers compensation, and professional indemnity.
We operate with deep respect for Aboriginal cultural heritage. All projects involving potential Aboriginal heritage sites are conducted in compliance with the Aboriginal Heritage Act 1972 (WA) and the Aboriginal Cultural Heritage Act 2021 (WA) as applicable. We will advise clients of their obligations under these Acts.
Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be lawfully excluded. Consumer guarantees apply to our services.
Subject to the ACL and to the fullest extent permitted by law, our total liability shall not exceed the fees paid by you in the 12 months preceding the event giving rise to the claim.
Each party agrees to keep confidential all non-public information. This obligation survives termination for 3 years. Cultural and heritage information shared by Aboriginal communities is treated with the highest level of confidentiality and respect.
Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
Disputes will first be addressed through good-faith negotiation, then mediation, and ultimately the courts of Western Australia.
